OFFICIAL RULES

OFFICIAL RULES:  No purchase necessary.  Void where prohibited. This sweepstakes is open only to legal United States residents.

HOW TO ENTER:  This sweepstakes begins at 12:01 a.m. Pacific time on August 26, 2008 and ends at 11:59 p.m. Pacific time on November 24, 2008 ("entry period").  You can enter this sweepstakes online via our website at www.bodybeautiful.com or by completing an entry form at a Body Beautiful Car Wash, Inc. ("Sponsor") location.  Sponsor locations can be found under the "Locations" tab at www.bodybeautiful.com.  You may complete the online entry form by visiting the sweepstakes registration page on the website and completing all of the required information and following all posted instructions.  You may complete a paper entry form at one of the Sponsor locations by completing all of the required information and following all posted instructions.  If you choose to enter online, your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking.  By entering, you agree to the terms of these official rules and to receive e-mails and other communication from Sponsor or its affiliates.  An eligible entrant may only enter via the online entry form or on a paper form at a Sponsor location during the entry period.  Limit one entry per person per week during the entry period; additional entries are void.

CONDITIONS OF ENTRY:  Eligible entrants must enter via the methods described above.  Incomplete entries are void.  By entering, entrants acknowledge compliance with these official rules, including all eligibility requirements.  Online entrants must be the registered subscriber of the e-mail account by which an applicable entry is made.  All entries become the property of Sponsor.  Neither Sponsor nor its affiliates, subsidiaries, divisions, advertising and promotion agencies, or any telephone network or service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any website or online set-vice, or any other error or malfunction, or late entries.

GRAND PRIZE WINNER: One eligible entrant will win a grand prize consisting of (1) coupons with a value totaling $1,000.00 which may only be redeemed for goods and services available at any of the Sponsor locations(provided, however, that in no event may such coupons be used to obtain any alcohol or tobacco products); and (2) 26 coupons each redeemable for one regular full service car wash (retail value $13.49 each).

WEEKLY WINNERS: Each week, two eligible entrants will win a weekly prize consisting of (1) coupons with a value totaling $100.00 which may only be redeemed for goods and services available at any of the Sponsor locations (provided, however, that in no event may such coupons be used to obtain any alcohol or tobacco products); and (2) two coupons each redeemable for one deluxe wash (retail value $25.99 each).

COUPONS:  Coupons may not be redeemed for cash and may only be used at the locations specified above; provided, however, that the issuance and redemption of coupons will at all times be in compliance with all then applicable law.

ODDS OF WINNING:  Odds of winning depend upon the number of eligible entries received.  Any taxes on prizes won will be the sole responsibility of the winners.  No substitution or transfer of prizes is permitted.

DRAWING:  The grand prize winner will be determined in a random drawing from among all eligible online and paper entries received by Sponsor by 11:59 p.m. Pacific time on November 24, 2008.  Each two weekly winners will be determined in a random drawing from among all eligible entries received by Sponsor by 11:59 Pacific time on the Monday of any given week during the entry period.  Sponsor will complete the grand prize drawing no later than December 10, 2008.  Prize winners may each be required to provide additional contact information and sign documents affirming their eligibility and providing a full release for the benefit of Sponsor and its affiliates.  Failure to return documents as required, or if prize notification is returned as undeliverable, will result in the entry being disqualified and an alternative winner being selected.

GENERAL CONDITIONS:  If there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the sweepstakes, or if technical difficulties compromise the integrity of the sweepstakes, Sponsor reserves the right to cancel or modify the sweepstakes if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the sweepstakes, as determined by Sponsor in its sole discretion.  In such event, Sponsor reserves the right to award the prizes by conducting a random drawing from among the eligible entries received up to the time of the impairment.  Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the sweepstakes or to be acting in violation of these official rules, or in an unsportsmanlike or disruptive manner.  Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.  Sponsor's failure to enforce any term of these official rules shall not constitute a waiver of that provision.   Should the sweepstakes be terminated prior to the end of the stated entry period, notice will be posted at www.bodybeautiful.com.

ELIGIBILITY:  This sweepstakes is open only to legal residents of the United States, 18 years of age or older at time of entry, who have an email address at the time of entry.  Employees and their immediate families, including household members of Sponsor, its affiliates, subsidiaries, divisions, advertising and promotion agencies are not eligible to enter.  Sponsor reserves the right to verify eligibility qualifications of any winner.

RELEASE:  Winners agree that Sponsor, its affiliates and their agencies and employees ("Released Parties") shall not be liable for injury, loss or damage of any kind resulting from participating in this promotion or from the acceptance or use of any prize awarded.  By entering this sweepstakes, entrant agrees to release and hold harmless Released Parties from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the sweepstakes or resulting, directly or indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the sweepstakes, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.

LIMITATIONS OF LIABILITY:  Released Parties are not responsible for:  (1) any incorrect or inaccurate information, whether caused by entrants, printing or errors or by any of the equipment or programming associated with or utilized in the sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the sweepstakes; (4) computer, network, technical, human or other errors or problems which may occur in connection with the administration of the sweepstakes or the processing of registrations or prize claims; (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the sweepstakes; or (6) typographical, printing or other errors in these official rules, the announcement of the prizes or in any sweepstakes-related materials.  If for any reason an entrant's registration form is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is completing another registration form in the sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the sweepstakes for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes.  No more than the stated number of prizes will be awarded.  In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these official rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all valid, non‑suspect eligible prize claims received.

DISPUTES:  Entrant agrees that:  (i) any and all disputes, claims and causes of action arising out of or connected with this sweepstakes, or any prizes awarded, other than the administration of the sweepstakes or the determination of winners, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Central District of California (Southern Division) or the appropriate California State Court located in San Diego, California; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this sweepstakes but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.  All issues and questions concerning the construction, validity, interpretation and enforceability of these official rules, or the rights and obligations of the entrant and Sponsor in connection with the sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

ENTRANT'S PERSONAL INFORMATION:  When you enter this sweepstakes, we may collect personally identifiable information and non-personally identifiable information from you.  Personally identifiable information includes information such as your name, email address, and zip code.  Non-personally identifiable information includes information such as cookies and any successor or similar technology. By entering this sweepstakes, entrants may, and agree to, receive marketing materials, communications and other materials from Sponsor and affiliated or other companies whose products and services Sponsor feels might interest entrants at a future date.
